1. Definitions
Company means Boldview Lodge Builders Construction. Client means the person or organisation engaging the Company. Contract means the accepted quotation, signed agreement, these terms, drawings, specifications and approved variations relating to the work.
2. Scope of work
The Company will perform the work described in the accepted quotation, contract, drawings and specifications. Work outside the agreed scope is treated as a variation and may change the price and completion date.
3. Quotations
- Quotations are valid for 30 days unless the quotation states another period.
- Prices are based on information available when the quotation is prepared.
- Errors, missing measurements, changed specifications or unexpected site conditions may require a revised quotation or variation.
4. Payment
- The deposit stated in the accepted quotation is payable before work starts or materials are ordered.
- Progress payments must be made according to the agreed schedule.
- The final balance is due at the stage stated in the contract or, if no stage is stated, on completion.
- Work may be paused while an amount remains overdue. Any late charge applies only where stated in the contract and permitted by law.
5. Variations
Client-requested changes should be recorded and approved in writing before additional work is carried out. The Company will explain the expected cost and timing effect where reasonably possible.
6. Project timing
Completion dates are estimates unless expressly guaranteed in writing. Weather, material shortages, labour disruption, government action, utility interruption, unexpected site conditions, delayed access or Client instructions may extend the programme.
7. Client responsibilities
The Client must provide accurate project information, safe and reasonable site access, timely decisions, any approvals allocated to the Client, and payment according to the agreed schedule. The Client must disclose known underground services, hazards and restrictions affecting the work.
8. Permits and approvals
Unless expressly included in the contract, the Client is responsible for obtaining planning permission, building approval, landlord consent and any other required permit before work starts.
9. Materials
The Company will use the specified materials or agreed equivalents. If a specified product is unavailable, the Company will communicate a reasonable proposed substitute before use where practicable. Natural materials such as timber and thatch may vary in shade, texture and appearance.
10. Health and safety
The Company will take reasonable measures to comply with applicable health and safety requirements. Clients and visitors must follow site instructions and must not enter restricted work areas without permission.
11. Workmanship and maintenance
Workmanship will meet reasonable industry standards and any warranty expressly recorded in the contract. Where the one-year free-maintenance promise is included, its covered work, start date and exclusions will be set out in the project documents. Normal wear, storm damage, misuse, neglected maintenance, third-party work and unauthorised alterations are excluded unless the contract states otherwise.
12. Liability
To the fullest extent permitted by Zimbabwean law, the Company is not responsible for indirect or consequential loss. Nothing in these terms excludes liability that cannot lawfully be excluded. Any contractual limitation will be applied fairly and subject to applicable law.
13. Insurance
The Company will maintain such insurance as is appropriate for its operations. The Client remains responsible for insuring the existing property, contents and any risk allocated to the Client unless agreed otherwise in writing.
14. Suspension or termination
The Company may suspend work for overdue payment, material breach, unsafe conditions or circumstances that make continued work unlawful or impracticable. A Client who terminates must pay for completed work, committed materials, demobilisation and reasonable cancellation costs, subject to the contract and applicable law.
15. Events beyond reasonable control
Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disasters, epidemics, war, civil disturbance, strikes, severe supply disruption or government restrictions. The affected party should notify the other as soon as reasonably possible.
16. Disputes
The parties will first try to resolve a dispute through good-faith discussion. If unresolved, they may agree to mediation or arbitration before court proceedings, where lawful and appropriate.
17. Governing law
These terms are governed by the laws of Zimbabwe, and the courts of Zimbabwe have jurisdiction unless the signed contract lawfully provides otherwise.
18. Acceptance and contact
Signing a quotation or contract, confirming acceptance in writing, or paying the required deposit constitutes acceptance of the applicable project documents. Questions may be sent through WhatsApp on +263 78 752 8709.
